Terms of service
The online store kaerdesign.ee (hereinafter referred to as the Online Store) is owned by OÜ COLORIN (registration code 17132496), located at Vindi tn 6, Tabasalu alevik, Harku vald, Harju maakond, 76901, Estonia.
Validity of the Sales Agreement, Product and Price Information
These sales terms and conditions apply when purchasing goods from the Online Store.
The prices of the products sold in the Online Store are displayed alongside the products. The price is subject to an additional delivery fee.
The delivery fee depends on the buyer’s location and the chosen delivery method. The delivery fee is displayed to the buyer during the checkout process.
Information about the goods is provided in the Online Store directly next to the product description.
Placing an Order
To order a product, the desired items must be added to the shopping cart. To complete the order, the required data fields must be filled in, and an appropriate delivery method selected. The total cost is then displayed, which can be paid using a bank link or another payment method.
The contract enters into force upon the receipt of the payable amount in the Online Store’s bank account.
If it is not possible to deliver the ordered goods due to the product being out of stock or for any other reason, the buyer will be notified at the earliest opportunity. Any amounts paid, including delivery costs, will be refunded without delay, but no later than 14 days from the date of the notification.
Delivery
All products are carefully packaged and ready to be gifted! Items are shipped within Estonia.
The delivery costs are borne by the buyer and are displayed alongside the chosen delivery method.
Shipping fees are calculated automatically based on one delivery address per order. When shipping to parcel terminals, the system selects the parcel locker size according to the largest item in the shopping cart.
Domestic shipments within Estonia generally reach the designated destination within 3-7 business days from the date the sales contract takes effect.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract within 14 days, provided the product is unused and in its original, undamaged packaging.
The right of withdrawal does not apply to legal entities.
To exercise the 14-day withdrawal right, the ordered goods may only be used in a manner necessary to verify the nature, characteristics, and functioning of the product, as is allowed in a physical store.
If the product has been used for purposes other than those necessary to ascertain its nature, characteristics, or functioning, or if it shows signs of use or wear, the Online Store has the right to reduce the refundable amount according to the decrease in the product's value.
To return a product, a withdrawal request must be submitted and sent to the email address info@kaerdesign.ee no later than 14 days after receiving the product.
OÜ COLORIN reserves the right to create products based on its unique style and creative vision. Disputes or claims arising from artistic or creative interpretations will not be accepted.
The returned product must be in its original packaging, with its original labeling, and in the same completeness as it was at the time of delivery to the buyer.
The buyer must return the product within 14 days of submitting the withdrawal request or provide proof that the product has been handed over to the carrier during this period.
The Online Store will refund the returned product upon receiving it, without delay but no later than 14 days after receiving the withdrawal request.
The Online Store may withhold reimbursement until it has received the returned product or until the buyer provides proof of having returned the product, whichever occurs first.
If the buyer has explicitly chosen a delivery method that differs from the least expensive standard delivery method offered by the Online Store, the Online Store is not obliged to refund the cost exceeding the standard delivery fee.
The Online Store reserves the right to withdraw from the sales transaction and reclaim the product if the product price in the Online Store has been marked significantly below the market price due to an error.
Right to file Complaints
The Online Store is responsible for the non-compliance or defects of the goods sold to the buyer that existed at the time of delivery. If defects are discovered upon receipt, the buyer must notify the Online Store within two months by sending an email to info@kaerdesign.ee.
The Online Store is not responsible for defects arising after the goods have been handed over to the buyer, including damages caused by improper use or negligence. Complaints arising from artistic or creative interpretations will not be considered.
If the purchased goods from the Online Store have defects for which the Online Store is responsible, the goods will be repaired or replaced. If repair or replacement is not possible, the Online Store will refund the buyer all fees associated with the sales agreement.
The Online Store will respond to consumer complaints in writing or in a format that allows for reproduction in writing within 14 days.
Dispute Resolution
If the buyer has any complaints regarding the Online Store, they should be sent to info@kaerdesign.ee.
If the buyer and the Online Store cannot resolve the dispute through agreement, the buyer may refer the matter to the Consumer Disputes Committee. The Consumer Disputes Committee is competent to resolve disputes arising from agreements concluded between the buyer and the Online Store. The examination of the buyer’s complaint by the committee is free of charge.
The buyer may also refer disputes to the European Union’s online dispute resolution platform.
